The collision of three Norfolk Southern trains in Pennsylvania early this month highlights the shortcomings of the automated braking system that was created to prevent such crashes. Not only was the system incapable of stopping the second train before it smashed into the back of a stopped train, but it also couldn't stop the third train. Congress required railroads to develop the positive train control system after a deadly 2008 collision between a Metrolink commuter train and a Union Pacific freight train in Chatsworth, California. Norfolk Southern's safety practices have been in the spotlight since one of its trains derailed in East Palestine, Ohio, in February 2023. The report also didn't say whether there were any curves or hills that made it hard for the crew to see the stopped train.

The shift in the volume of freight being moved from the East Coast to the West Coast was first highlighted in February in the ITS Port Rail Ramp Freight Index. (AP) — Transportation Secretary Pete Buttigieg has reiterated his concerns about railroad safety and scolded the industry for not doing more to improve since last year's fiery Ohio derailment. In a new letter to the freight railroads' main trade group, Buttigieg acknowledged that railroads say they are committed to safety. But he said too often regulators encounter resistance when trying to get the industry to do more to improve safety. And he said the Federal Railroad Administration's statistics don't show safety improving significantly over the past decade. But Buttigieg said that with two workers killed last year in rail yard accidents he's still concerned about those incidents.

The Trump administration used delegated authorities under three trade laws to unilaterally levy tariffs without Congressional approval. The Trump administration tariffs kickstarted a shift in supply chain strategy which, according to Frank, became more well-developed by customers during Covid, when they contemplated moving factories and production out of China. He expects any increase in tariffs during a second Trump presidency to lead to a greater shift in trade from China to Mexico to avoid the tariffs. "If you charge tariffs to China, they're going to build ... their car plants here and they're going to employ our people," Trump said. S&P Global research shows that China's share of the imports of products covered by tariffs imposed by the Trump administration has dropped.

Uber is going into the Dow Transports on Monday, marking the first change to the index since Dec. 7, 2021, when Old Dominion replaced Kansas City Southern. Under Dow Theory, the Transports should confirm a new high in the Dow Industrials. Uber is a funny add because unlike many of the other index components, it's not really a shipping company. The add likely reflects the Dow Transports index committee's belief that this is a transportation company, even if it just shuttles people instead of packages. This follows a well-known pattern called the S & P inclusion effect.

Before last year, paid sick leave was generally not offered to railroad workers. That's instead of joining all the other major freight railroads in negotiating jointly with rail unions on an agreement over pay and benefits. The rail industry reached the brink of a strike in the fall of 2022 before Congress and President Joe Biden intervened to force rail workers to accept a contract. Union Pacific, BNSF and Norfolk Southern now have paid sick time agreements in place with all their unions. Canadian National also trails behind the big U.S. railroads, but still offers sick time to about 46% of its U.S. workers.

The Omaha, Nebraska-based railroad said it earned $1.65 billion, or $2.71 per share, in the quarter. The results topped the estimates of the analysts surveyed by FactSet Research that called for earnings of $2.60 per share as Union Pacific hauled 3% more shipments. But Union Pacific's topped Wall Street's predictions for $6.05 billion. Union Pacific is one of the nation’s largest railroads and operates more than 30,000 miles of track in 23 western states.

CNBC's Jim Cramer on Friday told investors to gear up for a "fast and furious" slew of earnings reports next week that could lead to some profit-taking, including Procter & Gamble , Tesla and Lockheed Martin . Only if we still have plenty of people out there bad-mouthing the market and calling it dangerous and perilous," Cramer said. Tuesday is one of the busiest days of the week, with reports from Procter & Gamble , Verizon , 3M , Johnson & Johnson , RTX , Lockheed Martin , D.R. Cramer predicted Verizon will do well, but Procter & Gamble may not see a blowout quarter, perhaps creating a buying opportunity. He'll be waiting to hear about an increased defense budget from Lockheed Martin and said D.R.

What little suspense is left in the year revolves around whether the S & P 500 can close at a historic high. Closing the year at a historic high is a fairly rare event — it's only happened eight times since 1926, and only four times since 1963, according to S & P Global: 2020, 2013, 1999, 1991, 1963, 1958, 1954, 1928. So far, the S & P is up 0.9% in these first four of the seven days. The S & P internals are almost the opposite of where they were a year ago. S & P 500: overbought and expensive: Relative Strength Indicator (RSI): 72 (overbought) % stocks over 50-day- moving average: 89% (high, overbought) Forward earnings P/E: 19.6 (expensive) Earnings growth: 11% (high) Markets are positioned very bullish.
